Judgment

The present petition has been filed under Section 438 of the Code of Criminal Procedure (Cr.P.C.) for grant of concession of anticipatory bail to the
petitioners in case First Information Report No.179 dated 27.09.2017 under Sections 380, 403, 406, 420, 201 of the Indian Penal Code and Section 66
of the IT Act, 2000 registered at Police Station Sector 53, Gurugram (P-1).
It is contended by learned counsel for the petitioner that in pursuance of order dated 29.01.2018, the petitioner has joined investigation and his
custodial interrogation is no longer required. Learned counsel for the petitioner has handed over two demand drafts bearing No. 702738 and 169637
for an amount of Rs.86,000/- and Rs. 1,00,000/- respectively to learned counsel for the complainant in the Court today without prejudice the rights of
the petitioner. Photocopies of the same are retained on record.
On instructions from Sub Inspector Chander Bhallab, the above factual position is duly acknowledged by learned State counsel and stated that the
custodial interrogation is no longer required.
In view of the above, the order dated 29.01.2018 is made absolute subject to the provisions of Section 438(2) Cr. P.C.
Petition stands disposed off.
