Judgment
Arindam Lodh, J
Heard Mr. P. K. Biswas, learned senior counsel assisted by Mr. R. Nath, learned counsel appearing for the accused-applicant. Also heard Mr. B. Majumder, learned Dy. SGI appearing for the respondent-CBI.
The applicant is on bail. However, while granting bail, this Court had passed a direction that the applicant would not leave the station without permission of the investigating officer of the case.
Learned Dy. SGI has submitted that examination of prosecution witnesses is going on.
Mr. Biswas, learned senior counsel for the accused-applicant has submitted that for the last four years the applicant could not visit his home State. It is further submitted that the applicant has never violated the conditions of the bail. It is further submitted that the applicant has made an application to the investigating officer to allow him to go to his permanent residence at Uttarakhand, but, till today, the CBI has not responded to the said application.
In view of this, I direct the concerned investigating officer to take a decision over the matter within a period of 7(seven) days from today and to consider the case of the applicant sympathetically and communicate the same to the accused-applicant.
With the aforesaid direction, the instant I.A. stands disposed.
