Heard.

Applicant- Tanuj Semwal, who is in jail in connection with Crime No. 117 of 2011, relating to offences punishable u/s 457, 427, 380 and 411 of I.P.C., Police Station Nehru Colony, District Dehradun, has sought his release on bail.

Learned counsel for the applicant submitted that applicant has no criminal history. It is further submitted that there is no public witness of the alleged recovery of six sets of mobile phone, four re-charge coupons and three accessories, from the applicant. It is further pleaded that applicant has been implicated in the case only due to suspicion.

Having considered submissions of learned counsel for the applicant, and learned counsel for the state, and after going through the papers on record, without expressing any opinion as to final merits of the case, this Court is of the view that the applicant deserves bail.

The Bail Application is allowed. Let the applicant-Tanuj Semwal, be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Chief Judicial Magistrate, Dehradun.
