Judgment
Jagmohan Bansal, J
On 03.11.2025, the following order was passed by this Court:-
“The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of notification dated 15.06.2021 to the extent respondent has stopped allowances to Gallantry Award Laureat.
The petitioner was part of Punjab Police as Constable. He was awarded President’s Police Medal for Gallantry on 21.01.1995. He became entitled to Medal Allowance which was revised from time to time. The State Government vide notification dated 15.09.2021 stopped many allowances including Medal Allowance. The petitioner made representations to Commissioner of Police, Amritsar. The DGP vide communication dated 09.08.2023 addressed to Principal Secretary, Home Department, Punjab pointed out that employees are fully entitled to get Gallantry Award Allowance and should not be discontinued.
From the communication dated 04.07.2025 produced by learned State counsel as well as communication dated 09.08.2023, it comes out that Police Department is of the opinion that Medal Allowance should not be withdrawn. Communication dated 15.09.2021 (Annexure P-3) discloses that State has formed an opinion that allowances shall be paid after finalization of the issue.
Let an affidavit be filed by respondent before the adjourned date disclosing reasons and basis of stoppage of Medal Allowance which petitioner was getting since 1995 on account of President’s Police Medal.
Adjourned to 19.11.2025.”
Learned State counsel submits that authorities have accepted claim of the petitioner and his medal allowance would be revived.
In the wake of statement of learned State counsel, the petition stands disposed of.
It is made clear that medal allowance would be restored within two months from today.
