Dev Kant Trivedi, J.—Heard learned Counsel of parties on this application for bail moved on behalf of Tahloo in Crime No. 37/96 registered at P.S. Ram Nagar, Distt. Barabanki under Section 8/21 of N.D.P.S. Act.

It is urged on behalf of the applicant that he had made a complaint against the arresting officer Sri Kirpa Shanker Dixit, S.O. of P.S. Ram Nagar, Distt. Barabanki and feeling annoyed from the complaint, the applicant has been falsely implicated in this case, though nothing was recovered from his possession, which fact according to the learned Counsel of the applicant will stand fortified from the absence of any public witness of recovery though the alleged recovery was made at 7.20 p.m. It is also urged on behalf of the applicant that the accused is in jail for more than 20 months.

Looking into the circumstances of this case, the application for bail is allowed.

Let the accusedapplicant be released on bail on his furnishing two sureties and a personal bond to the satisfaction of the Chief Judicial Magistrate, Barabanki. Bail application allowed.
