The petitioners have assailed FIR No. 0352/2021 dated 09/10/2021 under Sections 376/109 IPC registered at Police Station Mendhar at the behest of respondent No. 3. It is submitted that petitioner No.1 had lodged FIR bearing No. 0347 dated 04.10.2021 against the husband of respondent No.3.
During the course of hearing, Mr. I. H. Bhat, learned counsel for the petitioner submits that this Court has already stayed the FIR lodged by the petitioner No.1 He further submits that the FIR impugned is a counter blast to the FIR that was lodged by petitioner No.1. He has produced the copy of the order dated 13.10.2021 passed in CRM(M) No. 623 of 2021 whereby the FIR lodged by petitioner No. 1 has been stayed. Copy of the same is taken on record.
Notice in the main as well as in the CrlM.
Mr. Jamrodh Singh Waives notice on behalf of the respondents 1 and 2.
Now notice shall go to respondent No.3.
List on 08.12.2021 along with CRM(M) No. 623 of 2021.
In the meantime, till next of hearing before the Court, investigation in the FIR impugned shall remain stayed.
