This Misc. application has been filed questioning the order dated 10.05.2024, passed by the District Magistrate, East Khasi Hills District, Shillong in proceedings drawn up under Section 144 Cr. P.C.
It is noted that the main writ petition is still pending adjudication and the subject matter concerns the road, over which customary tolls are being charged by the applicant (The Syiem of Sohra). It is also noted that in the main writ petition i.e. WP(C) No. 114 of 2022, interim orders are operating, which have been upheld up by the Division Bench of this Court in WA No. 23 of 2022. It appears that the District Magistrate, though it is stated is not party in the proceedings, has drawn up the proceedings without taking into account the pending writ proceedings.
As time is sought by Mr. N.D. Chullai, learned AAG, on the ground that the main matter is to come up on Monday, accordingly list this Misc. Case on 03.06.2024, together with WP(C) No. 114 of 2022. Objections may be filed in the meanwhile.
