Syed Mohammad Saeed vs State of U.P.

A. N. Gupta, J.—Counteraffidavit filed on behalf of complainantopposite party and rejoinder thereto, are taken on record.

Heard learned counsel for the applicant as well as learned counsel for the complainant.

Applicant Syed Mohd. Saeed is admitted to bail in case crime No. 20/95, under Sections 498A/323/427, I.P.C., P. S. Aminabad, Distt. Lucknow on his furnishing two sureties of Rs. 10,000 each and a personal bond in the like amount to the satisfaction of the C.J.M. Lucknow on the condition that the applicant shall surrender his passport before the C.J.M. Lucknow. It is made clear that the applicant shall not be released unless he surrenders his passport which shall be kept by learned Magistrate during trial. If after trial the applicant is acquitted, the passport may be returned. In case the applicant is convicted, the passport shall be impounded and shall be sent by learned C.J.M. to the office from where the passport was issued. The C.J.M. shall also inform the passport issuing office about this order.
