Judgment
Arindam Lodh, J
On reference under Section 20(2) of the Legal Services Authorities Act, 1987, the case is taken up today in the National Lok Adalat held in the Court premises of the High Court of Tripura.
The case is settled between the parties amicably as per the terms of settlement signed by them and the Conciliators/Members.
The case is disposed of in terms of settlement and the operative portion of the settlement reads as follows:
"Claimant-Appellant Sri Shyamal Paul and the representative of the respondent-Oriental Insurance Company Ltd. are present. The respondent-owner of the offending vehicle is also present.
The matter was discussed at length between the parties in presence of us and they arrived at a settlement to settle the appeal.
It is decided that the respondent-Oriental Insurance Co. Ltd. shall pay an amount of Rs.1,60,000/- (Rupees one lakh sixty thousand) only as enhanced amount in addition to the compensation as awarded by the learned Tribunal. It is further decided that the Insurance Company shall pay the enhanced awarded amount of Rs.1,60,000/- within a period of one month from today i.e. 11th September, 2021 otherwise, it shall carry interest @ 10% per annum from the date of filing of the appeal till the payment is made."
Terms of settlement have been placed in the case record and the same shall be treated as part of this order.
Accordingly, the O.P.-Insurance Company will pay the amount under the aforesaid terms.
Supply a copy of this order along with a copy of the terms of settlement to both the parties free of cost and also send a copy of this order with the terms of settlement to the concerned learned MAC Tribunal along with the LCR.
