Heard Mr. Biplabendu Roy, learned counsel appearing for the petitioner as well as Mr. Debalay Bhattacharya, learned Government Advocate appearing on behalf of respondent(s)-State.
Challenge in the present petition has been made to a show cause notice for cancellation of registration dated 06.06.2022 at Annexure-1 wherein allegation of fraudulent generation of E-way bills has been made against the writ petitioner.
The grievance of the petitioner is that while issuing the show cause notice, simultaneously order of suspension of registration was also passed without affording any opportunity of hearing to the petitioner.
Further, it is submitted on behalf of the petitioner that the petitioner could not submit a reply within the period as directed because the gateway or the website of the authority was not operational and he has, in fact, submitted the reply on 15.06.2022. He has also filed several applications before the authority, and in particular, Annexure-4 containing several prayers. Admittedly, the application made before the respondents under Annexure-4 remains pending consideration.
Therefore, this Court, while not being inclined to entertain the writ petition at the present stage, directs the respondent No.4-Superintendent of State Tax to dispose of the petitioner’s application(s) under Annexure-4 within a period of 4(four) working days from today.
The writ petition stands disposed of accordingly. Pending application(s), if any, also stands disposed of.
