M.M.S. Bedi, J.—This petition for cancellation of pre-arrest bail granted to respondent No.2 has been filed by attorney of complainant Gurraj Singh Virk, claiming that in violation of the orders dated July 30, 2011, respondent No.2 has left India without the permission of the Court. A copy of the application and the reply filed by respondent No.2 have been placed on record as annexures P-2 and P-3 to emphasize that respondent No.2 had filed an application before the Illaqa Magistrate seeking permission to go to Canada.

2.

Counsel for the petitioner states that without any permission of the Court, respondent No.2 has left India.

3.

On asking of the Court whether respondent No.2 at present is in India, counsel for the petitioner has expressed his ignorance about the said fact.

4.

Without expression of any opinion on the averments in the petition, this petition is dismissed for the reason that the petitioner does not have a locus standi to file the petition for cancellation of bail granted to respondent No.2. It will be open to the State or the complainant to approach this Court in case there is any violation of the conditions of grant of pre-arrest bail.
