Judgment
Arindam Lodh, J
Heard Mr. Samrat Ghosh, learned counsel appearing for the applicant.
Also heard Mr. R. Saha, learned PP appearing for the respondent-State.
This is an application filed under section 482 of the BNSS, 2023 for granting anticipatory bail to the applicant who is apprehending arrest in connection with Melaghar PS case No. 62 of 2024, registered under Sections 281/105 of the BNS, 2023 and Sections 184/187 of the M.A. Act.
In terms of Order dated 17.02.2025, learned Additional PP has produced the CC TV footage contained in a Pen Drive.
I have seen the footage wherefrom I find that the accident did not take place due to head-on-collision between the bike and the truck, but, the bike hit the backside of a Bolero Pickup truck and thereafter hit the rear side of the truck.
After observing the CC TV footage, prima facie this court is of the opinion that the applicant, driver of the truck cannot be held guilty of the alleged accident.
Accordingly, the interim bail granted to the applicant vide Order dated 17.02.2025 stands confirmed. It is ordered that, in the event of arrest, the applicant, namely, Swapan Kumar Das, may be released on bail on executing a bond of Rs. 50,000/- with one surety of the like amount to the satisfaction of the arresting authority.
With the above observations and directions, the instant application stands allowed and thus disposed.
