Judgment
The applicant has filed this bail application under Section 439 Cr.P.C in FIR No.138/2020 registered at Police Station Chiksana, District Bharatpur
for the offences under Sections 420 and 406 IPC.
Heard learned counsel for both the sides and perused the material made available on record.
Lerned counsel for the applicant submits that the applicant is quite innocent and he has been falsely implicated in the case. He is not required any
more for investigation. The applicant has not been named in the FIR. No criminal case has ever been registered against the applicant. Challan has
been presented. Conclusion of trial will take considerable time. The bail application should be allowed.
Learned Public Prosecutor has vehemently opposed the bail application.
Keeping in view all the facts and circumstances of the case and material available in the case diary, but without expressing any opinion on merits,
the bail application is allowed and it is directed that the accused applicant Swalin @ Bhura S/o Juharudin be released on bail provided he furnishes
personal bond in the sum of Rs.1,00,000/- (Rs.One lac) together with two sureties of the sum of Rs.50,000/- (Rs.Fifty Thousand) each to the
satisfaction of the learned trial court with the stipulation that he shall appear before that court and any other court to which the matter is transferred,
on all subsequent dates of hearing and as and when he is called upon to do so.
