RA no. 282 of 2023 (for review)

In Chamber

1.

This review application dated 12.09.2023 is filed against the order of this Commission in CC no. 262 of 2012 dated 07.07.2023. The applicant contends that the impugned order has failed to consider various averments made in the complaint challenging the order of the State Commission which had upheld the complaint filed by the respondent in the complaint.

2.

The complaint is delayed by 30 days. The application for the condonation of delay does not set out any reasons to justify the delay except to state that there was delay in obtaining a certified copy. No details regarding the reasons for the alleged delay have been provided. Merely on the basis of a bald assertion, the delay cannot be sought to be condoned. In view of the judgments of the Hon’ble Supreme Court in Anshul Aggarwal vs. New Okhla Industrial Development Authority, (2011) 14 SCC 578, Ram Lal and Ors. Vs. Rewa Coalfields Ltd., AIR 1962 Supreme Court 361, condonation of delay can be considered only when sufficient cause has been shown to the satisfaction of the court. In the instant case, the cause shown is insufficient while the delay of 30 days is admitted by the applicant.

3.

In view of the foregoing, the review application is dismissed in limine as not admissible as it fails to cross the threshold of limitation. All IAs are also dismissed. No costs.
