Mr. Majumdar, learned Advocate appears on behalf of the petitioner and submits that service is complete. As the instructing Advocate is in difficulty
due to personal reasons, the affidavit-of-service could not be produced in Court.
Let the matter appear on 1st July, 2021 before the appropriate Bench. Affidavit of Service is to be filed on the next date. A notice along with the
server copy of this order shall also be served upon the respondents via email and also by post.
Mr. Majumder further submits that the petitioner has mentioned certain admissible dues in paragraph 30 which are payable to the petitioner. Although
the writ petition has been filed challenging the entire disciplinary proceeding, according to Mr. Majumder the consideration of payment of admissible
dues which are not subject matters of the disciplinary proceeding, should be done by the respondents as the petitioner is suffering financial crisis.
I find substance in this submission of Mr. Majumder and direct the respondents to consider in accordance with the rules and regulations of the Bank
whether the admissible dues as stated by the petitioner can be paid.
Such information shall also be provided to the Court on the next date.
