Heard Mr.Mishra, learned Senior Advocate for the Appellant (Defendant No.2), Mr.K.M.H.Niamati, learned Advocate for Respondent No.1 (Plaintiff), Mr.M.Mohanty, learned Advocate for Respondent No.2 (Defendant No.1) and Mr.Purohit, learned Advocate for Respondent No.3 (Defendant No.3).
On the consent of all the parties, list both the appeals for final hearing on 29th June, 2022 on the substantial question of law that, whether the learned First Appellate Court by granting easement of grant has made out a new case which was no ones’ case.
I.A.No.10 of 2021
As an interim, it is directed that status quo ante as on the date of the judgment of the trial court that continued during the first appeal shall be maintained by the parties till 29th June, 2022.
In the meantime, copies of both the appeal memos shall be served on the counsels for respective Respondents.
Urgent certified copy of this order be granted on proper application.
