Judgment
The grievance of the petitioner is that an advertisement dated 11.09.2018 (Annexure P/1) has been issued for filling up of the post of Guest Lecturers,
however, in the advertisement the respondents have not taken into consideration the experience of the Guest Lecturers who have worked in the past
being any preferential treatment or any extra marks on their experience.
Yesterday i.e. on 26.09.2018, the counsel for the State was granted time to seek instructions. Today he makes a submission that the sole instruction
that he has received from the department is that, since the appointment of Guest Lecturers is for a period of 11 months and for verification of the
guideline/circular considerable time has consumed and therefore, the respondent authorities in Bilaspur District have issued advertisement without
insisting on the experience certificate.
At this juncture, the counsel for the petitioner has produced an advertisement of similar nature published in district Raipur so also identical
advertisement being issued for district Surguja wherein the experience of Guest Lecturers is being given due weightage as per the rules governing the
field.
Given the aforesaid facts circumstances of the case, particularly taking note of the advertisement which have been published for district Raipur as
well as district Surguja, this court is of the opinion that a strong case has been made out for grant of interim relief.
Accordingly, let the petitioner (s) also participate in the recruitment process which has been initiated by the respondents. Meanwhile, the respondents
would also explore the possibility of issuance of corrigendum incorporating experience factor also for which the other similarly placed candidates who
have got experience can also participate in the recruitment process.
Meanwhile, the respondents are directed to file a detailed reply at the earliest within three days.
