Judgment
I.A. No.1643 of 2019
The present application has been filed by the Appellant-Applicant (Accused No.14) (Rabi Sundaray) for bail pending disposal of the criminal appeal.
This Court has heard the submissions of Mr. B.S. Dasparida, learned counsel for the Appellant as well as Mr. J. Katikia, learned Additional Government Advocate for the State.
There are fourteen accused persons in all of which except two of them including the present Appellant-Applicant, i.e., Accused No.14, namely, Rabi Sundaray the other co-accused have already been enlarged on bail.
The present Appellant-Applicant has been in custody for over 9 years now. Also, the paper books in the criminal appeal are yet to be prepared.
Keeping in view the above circumstances and the decision of the Supreme Court of India in Surinder Singh @ Shingara Singh v. State of Punjab (2005) 32 OCR (SC) 430 and considering that it is unlikely that the present appeal will, in its turn, be heard at an early date, the Court considers it appropriate to direct that the Appellant/Applicant, namely, Rabi Sundaray (Accused No.14) shall be released on bail subject to the satisfaction of the Trial Court during the pendency of this appeal.
The application is disposed of. An urgent certified copy of this order be issued as per Rules.

The paper books be prepared and be supplied to the parties within eight weeks and, thereafter, to be immediately included in the list of final hearing of appeals.
