Judgment
IT is brought to our notice by the Counsel appearing for the respondent that in respect of the same grievance put forward in the present complaint, the complainant had preferred a complaint petition before the State Commission, Uttar Pradesh at Lucknow as complaint No. 146/SC/91 entitled M/s. Surya Scooters Pvt. Ltd. v. United India Insurance Co. Ltd. wherein he had claimed recovery of a compensation of Rs. 2,11,000/- and odd from the Opposite Party on the very same allegations and that the said complaint petition was dismissed by the State Commission as "not pressed" by its order dated the 16th December, 1991. It is thereafter that the complainant has chosen to approach this Commission with the identical grievance, after inflating the compensation amount claimed from 2 lakhs and odd to 36 lakhs and odd. After having given up his complaint as not pressed before the State Commission it is not open to the complainant to agitate the identical matter before this Commission by filing a fresh complaint petition here. The Original Petition is dismissed on this short ground. No costs.
