Judgment
Against the same corporate debtor, a petition under Section 7 of Insolvency and Bankruptcy Code, 2016 has already been admitted by the Hon'ble Principal Bench namely Mansi Brar Fernandes v. Gayatri Infra Planner Pvt. Ltd., [(IB)-752(PB)/2019] pronounced today (02.01.2020). As per the provisions of Section 11 of the Code, another Corporate Insolvency Process cannot be initiated against a corporate debtor that is undergoing a corporate insolvency resolution process. However, it is needless to add that the petitioners would be entitled to file their claim before the Insolvency Professional namely Mr. Manish Sukhani, with registration number IBBI/IPA-001/IP-P00668/2017-18/11137, email-id [email protected] and address B 213, Orchard Road Mall, Royal Palms, Aarey Colony, Goregaon(East), Mumbai, Maharashtra-400065 Mobile No. 9320089513 in accordance with law which shall be duly considered.
The petition is disposed of as having been rendered infructuous with liberty in terms of the order.
