Judgment
The petitioner is the Manager-cum-Secretary of Saraswati Convent School, Bangher Charat Singh, District Bathinda. The school has been set up by a Society named Saraswati Education Society, which is allegedly a non-profit organization. Initially the school was upto Class VIII. In the year 2018, the management decided to increase the number of classes upto Class X. Accordingly, it applied for affiliation with the Central Board of Secondary Education (CBSE). The CBSE directed the school management to first obtain recognition for the additional classes from the Punjab Government. According to the policy dated 26.11.2018 of the Punjab Government regarding grant of recognition, the school is required to deposit reserve money equivalent to 6 months salary of the staff (teaching+non-teaching). The condition of this deposit is the grievance of the petitioner.
Learned counsel for the petitioner submits that the reserve money aforementioned would amount to a sum of Rs. 18 lacs approximately and the said amount is exorbitant. It is beyond the means of the petitioner and, thus, a direction be issued to the State to grant recognition to the petitioner without complying with the requirement of payment of reserve money.
For grant of recognition, any school has to comply with the policy framed therefor by the State. Hardship/inability to make payment is no ground for waiver of deposit of reserve money.
The petition has no merit and is, thus, dismissed.
