Judgment
R.S. Chauhan, J.—Aggrieved by the order dated 01.02.2011, passed by the learned Additional Chief Judicial Magistrate, Gangapur City, District Sawai Madhopur, whereby the learned Magistrate has rejected the Petitioner''s application moved u/s 70(2) Cr.P.C., the Petitioner has approached this Court.
It is the case of the Petitioner that on 16.05.2000, the Police had submitted a charge-sheet for offence u/s 3/25 of Arms Act against the Petitioner. From 16.05.2000 till 19.12.2002, the Petitioner appeared and faced the trial. However, he jumped the bail on 19.12.2002. Therefore, arrest warrant was issued against him. In pursuance of the arrest warrants, he was produced before the court on 13.05.2003. However, on 02.05.2008, he against jumped the bail for which an arrest warrant has been issued against him. Although the Petitioner has claimed before the trial court that he was unable to attend the trial on 02.05.2008 as his mother was ill, but he has not submitted any documentary evidence to substantiate the said plea. Even before this Court, the Petitioner has not produced any document to support this plea.
Considering the fact that the Petitioner has already jumped the bail twice, this Court is not inclined to interfere with the impugned order dated 01.02.2011.
Therefore, this petition is devoid of any merit. It is, hereby, dismissed.
