Today, at the very outset, the learned counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to raise all the points raised herein before the trial Court at appropriate stage including his plea to the effect that he is principal of the college having impeccable record of 30 years and that he has been falsely implicated at the behest of some other employees against whom the petitioner had been contemplating taking action, and also his plea to the effect that an identical complaint filed by the complainant before Chief Minister Grievances Redressal Cell was looked into by Sexual Harassment Committee, wherein the allegations were found to be false and also his plea to the effect that the alleged incident of 2.8.2018 is falsified from the fact that the complainant was on leave on the said date in the college.

In view of the aforesaid submissions, the present petition is dismissed as withdrawn with liberty aforesaid.

It is further ordered that in case any application seeking exemption from personal appearance is moved by the petitioner before the trial Court, the same shall be considered sympathetically keeping in view the fact that the petitioner is presently working as a principal and has to attend to his official duties as well.
