This petition is filed by accused Nos.2 to 4 under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred as to ‘BNNS’) seeking grant of anticipatory bail in Crime No.29/2025 of Indiranagar P.S, Bengaluru for offences punishable under Sections 109, 238(B) and 249(B) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred as to ‘BNS’) pending on the file of X ACMM, Mayohall, Bengaluru.

Heard learned counsel for the petitioners and learned HCGP for the respondent – State.

The accusation against the petitioners is that they helped accused No.1 who assaulted first informant with knife on his neck. The petitioner helped accused No.1 in order to escape from catches of law and committed the offences alleged against them. There is no accusation of these petitioners assaulting the first informant or abating accused No.1 to assault the first informant. That the petitioner Nos.2 and 3 are women and petitioner No.1 is the father of accused No.1. There is no serious allegation against the petitioners and therefore, they are entitled for grant of anticipatory bail. In the result, the following:

ORDER

The petition is allowed. The petitioners/accused Nos.2 to 4 are granted anticipatory bail in Crime No.29/2025 of Indiranagar P.S, Bengaluru, for offences punishable under Sections 109, 238(B) and 249(B) of BNS pending on the file of X ACMM, Mayohall, Bengaluru, subject to the following conditions:

1) The petitioners/accused Nos.2 to 4 shall execute a personal bond for a sum of `1,00,000/- each with one surety for the like sum to the satisfaction of the investigating officer.

2) The petitioners/accused Nos.2 to 4 shall voluntarily appear before the investigating officer within two weeks from this day and execute a bail bond and furnish surety.

3) The petitioners/accused Nos.2 to 4 shall cooperate with the police investigation.

4) The petitioners/accused Nos..2 to 4 shall not tamper the prosecution witness.
