Judgment

This petition has been filed mainly on the ground that the first accused along with A3 and A4 filed Crl.O.P.(MD)No.14274 of 2021, which was partly allowed, insofar A3 and A4 and was dismissed insofar as the first accused. Against which, A1 filed a Special Leave Petition, before the Hon'ble Supreme Court, in S.L.P.No.24670 of 2022, for quashing the entire proceedings against the above said accused and the same was allowed.
The learned counsel for the petitioners would submit that the petitioners are standing on better footing than the first accused, A3 and A4. The first accused being the Director and the second accused-first petitioner herein, being another Director of the above said Company. The second petitioner herein-A5, is the wife of the first petitioner.
Notice to the second respondent returnable by 24.07.2023.
Private notice is also permitted.
In the meantime, further proceedings in C.C.No.131 of 2021,pending on the file of the Judicial Magistrate No.I, Kanyakumari District, shall be kept in abeyance. The personal appearance of the petitioners herein is ordered to be dispensed with.
