Judgment
Proceedings of this matter have been takenÂup through video conferencing.
In first round of litigation in writ petition filed in the shape of WPS No.1126 of 2009 the petitioner claimed that he is entitled for promotion from the
post of Branch Manager, GradeÂII to Branch Manager, Grade I w.e.f 20.7.2004, but this Court by order dated 18.1.2010 directed the Bank to
consider the case of the petitioner for promotion from the post of Branch Manager, GradeÂII to Branch Manager, GradeÂI and further directed that
appropriate orders shall be passed within a period of eight weeks from that day. Pursuant to which, respondent No.2ÂBank considered the case of the
petitioner on 2.4.2010 and promoted him on the post of Branch Manager, GradeÂI, which the petitioner accepted and joined the post and thereafter
retired from service w.e.f. 31st August, 2010 and thereafter filed the instant writ petition stating interÂalia that he is entitled for promotion on the post
of Branch Manager, GradeÂI w.e.f. 20.7.2004.
No one has appeared on behalf of respondent No.2ÂBank.
I have heard learned counsel for the petitioner and perused the documents appended with the writ petition.
It appears from the record that this Court on 18.1.2010 only directed the respondentÂBank to consider the case of the petitioner for promotional
post of Branch Manager, GradeÂI which the respondent Bank considered and promoted him by order dated 2.4.2010, which he joined willingly and
now this writ petition has been filed.
The petitioner has not claimed any such relief that he will be promoted on the post of Branch Manager, Grade I with retrospective effect from
20.7.2004 by making representation before respondent No.2ÂBank and directly filed this writ petition on 21.4.2010 within 15 days days from the date
of promotion on the post of Branch Manager, GradeÂI and till this cate, the petitioner has not made any representation for redressal of his grievance
and therefore, it would be appropriate to grant liberty to the petitioner to make a representation before respondent No.Â2ÂBank for redressal of his
grievance that he was entitled for promotion on the post of Branch Manager, GradeÂI from 20.7.2004.
If such a representation is made within 30 days from today before respondent No.2ÂBank, respondent No.2Â Bank within next 30 days will
consider the case of the petitioner if he was entitled to be promoted from that day and pass a reasoned and speaking order within that period of time.
With the aforesaid observation / direction, the present writ petition finally stands disposed of. No order as to cost(s).
