The petitioner is the accused in three crimes registered by Tanur Police. According to him, he has been falsely implicated in all the three crimes

without conducting proper investigation. He submitted Ext.P4 representation to the State Police Chief highlighting his grievance seeking further

investigation of the three crimes. The said representation was forwarded to the District Police Chief, Alappuzha who conducted enquiry through the

Deputy Superintendent of Police, Tanur. It was found that the allegations in Ext.P4 representation were not correct and accordingly further

proceedings consequent to Ext.P4 order was dropped as per Ext.P5 order.

The grievance of the petitioner is that Ext.P4 was not properly considered. The learned counsel for the petitioner submitted that the petitioner was

not given opportunity of being heard before passing Ext.P5 order. A perusal of Ext.P5 order would show that it is in the form of a letter and is not

supported by reasons. No opportunity is seen given to the petitioner of being heard.

In these circumstances, I am of the view that this writ petition can be disposed of with a direction to the District Police Chief, Malappuram to

consider and dispose of Ext.P4 afresh, within a period of one month, untramelled by Ext.P5 order, after giving opportunity to the petitioner for hearing.

The writ petition is disposed of.
