Judgment
Learned counsel for the applicants was heard through video conferencing.
The present bail application has been filed under Section 439 Cr.P.C. on behalf of the applicants, who are in custody in connection with FIR No. 215/2020, Police Station Sumerpur, District - Pali for the offences under Sections 353, 332 & 188 IPC.
It is submitted by learned counsel for the applicants that the allegations pertained to violation of guidelines of COVID-19 and the fact that the applicants misbehaved with the officers during the said period, however, the offence alleged against the applicants is triable by Magistrate.
Learned Public Prosecutor has opposed the bail application.
In the circumstances of the case, without expressing any opinion on the merits of the case, this Court is of the opinion that the bail application filed by the applicants deserves to be accepted.
Consequently, the bail application is allowed. It is ordered that the accused-applicants - (1) Suresh Kumar S/o Prabhuram & (2) Dinesh Kumar S/o Desharam arrested in connection with FIR No. 215/2020, Police Station Sumerpur, District - Pali, shall be released on bail; provided they furnish a personal bond of Rs.50,000/- (Rupees Fifty Thousand Only) each with two sureties of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
