I.A. No.353 of 2024

Heard learned counsel for the petitioner and learned counsel for the State.

This I.A. has been filed seeking for interim release of the Petitioner in connection with Special (NDPS) Case No.126 of 2023 pending on the file of learned Additional Sessions Judge-cum-Special Judge, Kantamal, arising out of Manamunda P.S. Case No.109 of 2023 for commission of offence alleged under Sections 20(b)(ii)(C) of the NDPS Act, to facilitate the treatment of his mother who is stated to be requiring dialysis.

To test the veracity of the statement, a report was called for through the learned counsel for the State.

The instruction received from the concerned police station indicates that the mother of the Petitioner is diagnosed with kidney disease and the medical certificate dated 25.03.2024 annexed to the interim application reveals that dialysis is required. The instruction is taken on record.

Taking note of the same, without entering into the contours of the merit, this Court on humanitarian ground, directs the Petitioner to be released on interim bail till 17th June, 2024. Terms to be fixed by the learned Court in seisin.

During the currency of the interim bail period, it is directed that the Petitioner shall submit his mobile number before the learned Court in seisin and shall appear before the jurisdictional police station once every week on such date and time to be fixed by the learned Court in seisin. Certification of such appearance shall be submitted to the learned Court in seisin.

It is further directed that during the interregnum the Petitioner shall not indulge himself in any other offence.

It is needless to state that on expiry of the interim bail period, the Petitioner shall surrender on 18th June, 2024.

Accordingly, the I.A. stands disposed of.

Urgent certified copy of this order be granted as per rules.
