This is the first Bail Application filed by the Applicant under Section 439 of Cr.P.C. seeking for grant of regular bail as he has been arrested on 26.1.2022 in connection with Crime No.20/2022 registered at Police Station Khamhardih, Raipur, for the offence punishable under Section 379 read with Section 34 of I.P.C.

According to the Prosecution, a complaint was lodged by the Complainant on 25.1.2022 before Police Station Khamhardih, Raipur by alleging inter alia that, on the date of incident, i.e., 20.1.2022, some unknown persons had entered into the Anandam World City and committed theft of certain construction articles like – drainage cover, chamber cover and heavy light, total amounting to Rs.12,000/-. Based upon the said complaint, an investigation was made and during the investigation, the alleged articles were recovered from the house of the Applicant and in view thereof the alleged offence, as mentioned hereinabove, has been registered against him by the concerned Police Station in connection with Crime No.20/2022.

Learned Counsel for Applicant submits that the Applicant is innocent and has been falsely implicated in connection with the alleged crime. He further contended that as the Applicant is in Jail since 26.1.2022 and the Trial may take some time to conclude, therefore, the Applicant may be enlarged on Bail.

On the other hand, learned Deputy Government Advocate appearing for the State opposes the Bail Application.

Having considered the aforesaid contentions put forth by the learned Counsel for the parties and considering further the recoveries of the alleged stolen articles from the house of the Applicant, I am not inclined to enlarge the Applicant on Bail.

Accordingly, the Application for grant of Bail is rejected.
