The present criminal misc. application has been filed by the applicant-petitioner, in which it is mentioned that the parole being S.B. Criminal Writ Petition No.1706/2023 has been filed by the petitioner-convict Suresh Bhil before this Court and the same was allowed vide order dated 01.11.2023, with the condition to furnish two sureties for a sum of Rs.50,000/- each and a personal bond of Rs.1,00,000/-.
Counsel for the petitioner submits that the petitioner is a very poor person and he is not in a position to furnish sureties as ordered by this Court, therefore, the order dated 01.11.2023 may be modified and he may be released on furnishing his personal bond of Rs.1,00,000/-.
Learned Assistant to Addl. Advocate General filed reply in this matter and opposed the prayer made by the counsel for the petitioner-applicant.
In view of above, the order dated 01.11.2023 passed in S.B. Criminal Writ Petition No.1706/2023 is hereby modified and the petitioner-applicant Suresh Bhil S/o Shri Ratan Lal, may be released on parole for a period of twenty days’ upon his furnishing personal bond in the sum of Rs.1,00,000/- only and condition of two sureties of Rs.50,000/- each is hereby waived.
The present application is decided accordingly.
