Judgment
R.S. Chauhan, J.—Aggrieved by the investigation done in FIR No. 39/2011 registered at Police Station Udaipurwati, District Jhunjhunu for offence u/s 376 IPC, the Petitioner has approached this Court.
Mr. Sunil Kumar Singodiya, the learned Counsel for the Petitioner, has made an extremely limited prayed that the Petitioner be permitted to place the documents which are in his favour before the Investigating Officer and direction should be issued to consider these documents to decide whether prima facie case is made against the Petitioner or not.
The prayer, so made, is a reasonable one. Therefore, without interfering with the investigation of the FIR, this Court directs the Investigating Officer to consider all the documents being placed by the Petitioner before him. It is expected that the Investigating Officer will consider all the documents objectively and shall not be influenced by any extraneous consideration. The Investigating Officer should not only examine the documents, but also objectively decide whether a case is made out against the Petitioner or not.
With these observations, this petition is, hereby, disposed off.
