Judgment
These petitions have been filed under Section 482 Cr.P.C for fair and effective investigation in FIR No.191/2020 registered at Police Station
Bhimganj Mandi, Kota City for the offences under Sections 406, 467, 468, 471 and 120-B IPC, FIR No. 202/2020 registered at Police Station
Bhimganj Mandi, Kota City, Kota for the offence under Section 406 IPC, FIR No.385/2020 registered at Police Station Gumanpura, Kota City, Kota
for the offence under Section 406 IPC and FIR No.433/2020 registered at Police Station Gumanpura, Kota City, Kota for the offences under Sections
201, 445, 452 and 511 IPC respectively.
Heard learned counsel for both the sides and perused the material made available on record.
Learned counsel for the petitioners submits that in all above FIRs registered by the complainant-petitioners, no fair and effective investigation is
being conducted under the influence of accused persons and respondent No.3- Rajesh Meshram, Circle Officer-V (Dy. Superintendent of Police),
whereas the matters are based on strong documentary and electronic evidence but till date no effective steps have been taken despite representation
to the Inspector General, Police Range, Kota, therefore either the investigation should be transferred to S.O.G., Jaipur or the I.G., Police Range, Kota
should be directed to inquire into the allegations of the petitioners and ensure effective investigation in the matters.
Learned Public Prosecutor submits that appropriate directions may be issued.
Keeping in view the submissions made at bar and the material made available on record, the petitioners are directed to file fresh representation to
the I.G. Range, Kota containing all their grievances within three days and on receipt of the same, the I.G. Police Range, Kota shall ensure that
effective and expeditious investigation is conducted in above FIRs strictly in accordance with law without being influenced by any extraneous
consideration.
Learned Public Prosecutor is directed to procure latest status report of the investigation by the next date positively.
