Surendra Nath Shahi And Another vs Director of Agriculture U.P. & Others

This writ petition is directed against an order dated 8.1.1987 contained in Annexure2 by which, the petitioners were repatriated to their parent department. The only grievance of the petitioners made at the time of hearing is that in the parent department, a number of persons junior to the petitioners have been promoted to higher posts and if the petitioners are repatriated, they would be placed on the original post held by them i.e. they would become junior to their juniors. If a person is sent on deputation to another department, he does not thereby lose his right to be considered for promotion in the parent department. At the time of promotion, the petitioners who were working on deputation should also have been considered for promotion and notional promotion should have been granted to them so that after repatriation they could have been placed on higher posts. But this does not appeal to have been done. The opposite parties shall now consider the petitioners for promotion on higher post. This may be done within next 3 months from the date of communication of this order to the opposite parties.

Subject to the above, the writ petition is disposed of finally in the manner stated above.
