Heard the parties.
The applicant, who is in custody since 14.08.2023, has approached this Court for grant of regular bail in connection with Dhab P.S. Case No.06 of 2023 registered for the offence under Sections 147, 148, 149, 323, 341, 307, 354, 427, 504 and 506 IPC, pending in the court of J.M., 1st Class, Koderma.
It has been submitted by the counsel for the applicant(s) that complete set of FIR/ Complaint Case along with its enclosure have been annexed with this bail application and there is no suppression on the part of the applicant(s).
Innocence has been claimed and participation in the trial has been assured. It has been submitted that due to village politics, this false and frivolous case has been lodged. At best, it is a case of an attempt. On the above facts, prayer for bail has been made.
On the other hand, learned A.P.P. has opposed the prayer for bail and it has been submitted that there is direct allegation of outraging the modesty.
Considering the nature of allegation and the material available on the record, I am not inclined to enlarge the applicant (s) on bail. Accordingly, the prayer for bail of the applicant(s) stands rejected.
