The petitioner, who is under incarceration since 28th May, 2017, for commission of offence punishable under Section 302 IPC, has come up before
this Court seeking regular bail.
Based on a complaint, the police arrested the petitioner on 28th May, 2017, in FIR No.250 of 2017, dated 28.05.2017, registered under Section 302
of Indian Penal Code, 1860, (IPC), in Police Station, Paonta Sahib, District Sirmaur, Himachal Pradesh, disclosing cognizable and non-bailable
offences.
Status report filed. Mr. Deepak Kaushal, Advocate has also shown the copy of the statements of witnesses already examined by the trial Court.
Mr. Anil Jaswal, learned additional Advocate General submits that the trial is at the fag end and only four prosecution witnesses have left to be
examined. At this stage, any observation on bail by this Court may influence the trial. Mr. Deepak Kaushal, Advocate learned counsel representing
the petitioner after arguing for considerable time states that he would not press this petition on merit, provided this Court directs the trial Court to
expedite the matter.
Given the fact that the petitioner is in custody for the last more than three and a half year, this petition is closed and this Court requests the trial Court
to conclude the trial on top most priority preferably on or before 31st March, 2021. Pending application(s), if any, shall also stand disposed of.
