It is the contention of the learned senior counsel for the petitioners that the case of petitioners No. 2 to 4 is identical to the co-accused Sheela,

Angrejo, Santro and Sunita, who have been granted the benefit of anticipatory bail by this Court vide order dated 28.02.2018 passed in CRM-M-

7326-2018 titled as Smt. Sheela and others vs. State of Haryana. He contends that as regards petitioner No. 1-Surat Singh, the only distinguishable

factor would be that the said petitioner is alleged to have snatched the revolver along with cartridges from the complainant and surrendered the same

in the police station on 15.03.2017 which is prior to the date of registration of the present FIR i.e.16.03.2017. He, therefore, contends that no

recovery has to be effected from the petitioners and the petitioners are ready and willing to join investigation and co-operate with the same. The

challan stands already submitted and the petitioners have approached this Court only after the rejection of the application for grant of bail by the trial

Court on addition of Section 379-B IPC.

Notice of motion.

On the asking of the Court, Mr. Apoorv Garg, DAG, Haryana, accepts notice on behalf of the State. Mr. Keshav Partap Singh, Advocate, has put in

appearance on behalf of the complainant.

Having heard the counsel for the parties and keeping in view the order dated 28.02.2018 (Annexure P-13), which covers every aspect with regard to

the arguments, which have been raised by the counsel for the parties and finding the case of the petitioners similar to that of the co-accused, who

have been granted the benefit of concession of anticipatory bail, the present petition is allowed.

Petitioners are directed to appear before the trial Court on 07.04.2018, the date fixed before the trial Court. On an application being moved by the

petitioners for grant of regular bail, they shall be admitted to regular bail by the trial Court to its satisfaction.

Copy of the order be given DASTi under signatures of the Bench Secretary of this Court.
