Judgment

Heard Mr. Bharat S. Patel, learned Senior Advocate assisted by Mr. Chirag B. Patel, learned advocate for the appellant, Mr. Tejas P. Satta, learned advocate for the respondents no. 1 to 17 and Mr. Tirthraj Pandya, learned AGP for the respondent no. 18.
Mr. Patel has submitted that the lands were acquired for the public purpose of the appellant and the parties have entered into compromise and have agreed to the compensation as provided in the compromise purshis. Learned advocate Mr. Tejas Satta, who has instructions to appear for the respondents no. 1 to 17, also states that the parties have amicably resolved the issue and the compromise purshis is also on record. The appellant has also filed an application for condonation of delay in bringing heirs of the original claimants / land owners on record along with the copy of the application for bringing the heirs on record.
Mr. Bharat Patel, learned Senior Advocate for the appellant and Mr. Tejas Satta, learned advocate for the respondents no. 1 to 17 state that as such the issues is resolved and therefore, the proceedings of the appeal be referred to the Gujarat High Court Mediation Centre.
In facts of this case, the proceedings of First Appeal no. 1397 of 2019 along with the pending Civil Applications are referred to the Gujarat High Court Mediation Centre. In facts of this case, Mr. H.S. Mulia, learned Member Secretary, Gujarat State Legal Services Authority is hereby nominated as Mediator, more particularly, considering the present pandemic Covid-19 situation. Mr. Patel as well as Mr. Satta shall appear through Zoom Video Conferencing platform before Mr. H.S. Mulia, learned Member Secretary tomorrow. Mr. Mulia is hereby requested to do the needful.
