Suraj.S.J vs Dr.A.P.J.Abdul Kalam Technological University

The grievance of the petitioner in this writ petition is relating to denial of attendance for the subject 'Industrial Engineering'. Petitioner submits that he has approached the Students Grievance and Redressal Cell of the University, pointing out this. Petitioner is an 8th Semester, B.Tech Mechanical Engineering student of Sree Narayana Institute of Technology, Theppupara affiliated to Dr.A.P.J Abdul Kalam Technological University. He has submitted Ext.P12 petition before the Students Grievance and Redressal Cell of the University. According to the petitioner, because of the reduction of attendance/arbitrary calculation of the attendance, he has become ineligible to appear in the 8th Semester Examination being held.

I heard shri Manu Ramachandran, the learned Counsel appearing for the petitioner, Shri Elvin Peter, the learned Standing Counsel appearing for the University and Shri Biju Balakrishnan, the learned Counsel appearing for the College.

Though, the learned Counsel for the respondent College refutes the allegation raised by the petitioner, as it is seen that the Examination is being held, let the complaint of the petitioner be decided by the Students Grievance and Redressal Cell after hearing the petitioner as well as the College in accordance with law. The eligibility of the petitioner to appear in the examination can be decided on the basis of the decision to be taken by the Students Grievance and Redressal Cell.

Accordingly, the writ petition is disposed of, directing the University to place Ext.P12 complaint submitted by the petitioner before the Students Grievance and Redressal Cell-the 4th respondent, for appropriate decision in accordance with law, after hearing the petitioner and the College authorities.

In the meanwhile, the petitioner shall be permitted to appear in the remaining examinations of 8th Semester provisionally and subject to the decision to be taken by the Students Grievance and Redressal Cell. It is made clear that petitioner would not be entitled to any equitable relief merely based on this permission granted for appearing in the examination.
