The accused/applicant seeks regular bail in case FIR No. 156/2026 of Police Station Hazrat Hizamuddin, South-West District, Delhi for offence under Section 20/61/85 of NDPS Act.

Broadly speaking, prosecution case is as follows. On the basis of secret information, the Anti-Narcotic Squad arrested the co-accused Arif on 03.06.2026 from Bhogal and from his possession, 10.750 kg ganja was recovered. Arif disclosed that he had been procuring ganja from Odisha through the present accused/applicant and co-accused Jagannath. On the

basis of disclosure statement of Arif, the present accused/applicant and co-accused Jagannath were arrested and they confessed to their involvement.

Learned counsel for accused/applicant submits that nothing incriminating was recovered from the accused/applicant and he has been involved in this case only on the basis of disclosure statement of Arif.

Learned APP for State assisted by IO/SI Yashpal accepts notice and in all fairness admits that presently there is no legally admissible evidence against the accused/applicant.

The IO submits that there is telephonic connectivity between the present accused/applicant and Arif. But the IO also fairly admits that he has not found the Customer Application Form to establish that the alleged connectivity is between the accused/applicant and Arif.

Considering the above circumstances, I do not find any reason to deprive further liberty to the accused/applicant. Therefore, the bail application is allowed and accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Trial Court.

A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.

Accompanying application also stands disposed of.
