B y way of this application under Section 482 of CrPC, the applicant seeking modification of order dated 20.04.2023 passed by this Court in MCRC 14106 of 2023 whereby this Court had granted bail to him subject to furnishing a cash surety of Rs.25,000/-.
It is contended on behalf of applicant that applicant is in custody since 06.12.2020 in connection with offence punishable under Sections 363, 366-A and 376 (2)(N) of IPC and Section 5 (L)/6 of POCSO Act. He is a poor person and rustic villager and living in the pathetic condition and family members of the petitioner are hand to mouth. He is unable to furnish the cash surety of Rs.25,000/- as imposed by this Court while granting bail to him as his financial condition is not good.
Considering the grounds made on behalf of applicant, in the interest of justice, this application is allowed and is directed that the applicant shall furnish a cash surety of Rs.5,000/- in place of Rs.25,000/- and remaining condition shall remain as it is.
The order dated 20.04.2023 is accordingly modified to the extent indicated above.
MCRC stands disposed of.
A copy of this order be read conjointly with order dated 20.4.2023 passed in MCRC 14106 of 2023.
