Judgment

The Court:- The petitioner is an employee of the West Bengal Transport Corporation Ltd. He was appointed on 1st November, 2010.
The learned advocate appearing on behalf of the petitioner submits that according to the guidelines which are followed for implementation of the
Career Advancement Scheme an employee is entitled to receive the benefit of first career advancement after completion of 8 years of service.
According to the petitioner, he completed 8 years of service in the year 2018.
The grievance of the writ petitioner is that the Career Advancement Scheme benefit has not been extended in his case.
The petitioner relies upon instances where employees who were appointed after 1994 had been extended the benefit of the Career Advancement
Scheme after completion of 8 years of service. The petitioner submits that he has been discriminated.
The petitioner made a representation before the respondent authority by letter dated 16th August, 2019 praying for disbursal of the benefit under
Career Advancement Scheme. The said representation is yet to be disposed of by the respondents.
The learned advocate appearing on behalf of Respondent authority is not ready with instruction.
Since it appears that the petitioner has already raised his grievance by way of representation in August, 2019 and the same is pending consideration
before the respondent authority, accordingly, no useful purpose will be served by keeping the writ petition pending.
The same is accordingly disposed of by directing the respondent no.4 being the Managing Director of the West Bengal Transport Corporation Ltd.
formerly known as The Calcutta Tramways Company (1978) Ltd. to consider the representation made by the petitioner praying for grant of Career
Advancement Scheme benefit on completion of 8 years of service strictly in accordance with the guidelines which are followed for implementation of
the Career Advancement Scheme within a period of six weeks from the date of communication of a copy of this order upon giving an opportunity of
hearing of the petitioner. The said respondent shall pass a reasoned order and communicate the same to the petitioner within a fortnight thereafter.
It is made clear that this Court has not gone into the merit of the prayer made by the petitioner and all points are left open to be decided by the said
respondent at the time of consideration of the representation made by him.
WP No.57 of 2020 is disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
