Judgment

Petitioner is seeking anticipatory bail in FIR No.194 dated 04.11.2025 u/s 318(4), 338, 339, 340 of Bharatiya Nyaya Sanhita, 2023 registered at Police Station Chhansa, District Faridabad, Haryana.
It is the case of petitioner that false complaint/FIR has been lodged against her as she has not sold any land pertaining to complainant Umesh Sharma nor had signed on behalf of complainant Umesh Sharma though the name of complainant Umesh Sharma was mentioned in the receipt vide which earnest money was received as his brother, namely Ishwar, who was also one of the sellers has represented that he will get consent of complainant Umesh Sharma also.
It is the case of petitioner that since no signatures have been appended by complainant, therefore, the agreement is not on behalf of complainant. It is asserted that petitioner is ready to join investigation and custodial interrogation in the facts and circumstances of present case is not justified.
Status report by way of affidavit of Mr. Ashok Kumar HPS, Assistant Commissioner of Police, Tigaon, District Faridabad has been filed.
On consideration, I do not find any reasons for arrest of present applicant in present case in view of facts made out from FIR as well as from status report. Investigation of present case can be made without resorting to arrest of petitioner. Custodial interrogation of petitioner is not justified in the facts and circumstances of present case.
In the event of arrest, petitioner be released on bail on furnishing bail bonds in the sum of Rs.1,00,000/- with one surety of like amount to the satisfaction of IO/SHO/arresting officer. Petitioner shall join the investigation forthwith and cooperate with the investigating agency.
Disposed of accordingly.
