Judgment

The present petition has been filed by the petitioner for grant of anticipatory bail in case FIR No.8 dated 12.01.2025, registered under Sections 109, 3 (5) of BNS and Sections 25 and 27 of Arms Act (Section 61(2) of BNS added later on vide rapat No.23 dated 24.01.2025), at Police Station Guruharsahai, District Ferozepur.
Vide order dated 19.11.2025 passed by this Court, the petitioner was granted interim bail and was directed to join investigation.
Status report has been filed by ASI Bhupinder Singh, Police Station Guruharsahai, District Ferozepur, who is present in person before the Court. He has submitted that the petitioner has joined the investigation on 25.11.2025 and his custodial interrogation is not required. Though none is present on behalf of the petitioner as the bar is abstaining from the Court work, however keeping in view the nature of the allegations, this Court is of the considered opinion that pre-trial incarceration of the petitioner is also not required. As such, a case is made out for allowing the present petition. Accordingly, the present petition is allowed and the order dated 19.11.2025, granting interim bail to the petitioner, is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (analogous to Section 438(2) of the Code of Criminal Procedure).
