In the head note of the petition, following prayers have been made:-

“CIVIL WRIT PETITION under Articles 226/227 of the Constitution of India for the issuance of an appropriate writ, order or direction, especially a writ in the nature of mandamus directing the respondents to issue letter of intent pursuant to e-auction of 06 marla residential plot No 1924 in Sector-26, Panchkula (Annexure P-1) as the petitioner has already deposited 15% of the amount i.e. 5% at the time of participation in auction and 10% on notice issued by the department dated 20.03.2026 (Annexure P-1), in the interest of justice, equity and fairplay.

AND/OR Further for the issuance of an appropriate writ, order or direction specially a writ in the nature of mandamus directing the respondents to decide the legal notice dated 16.07.2026 (Annexure P-6) sent through registered post on 22.07.2026 and consequent thereto issue the letter of intent to the petitioner, in the interest of justice, equity and fairplay;

AND/OR For the issuance of an appropriate writ, order or directions specially an ad interim directions to the respondent to not to further auction of the said plot during the pendency of the present petition, subject to the final outcome of the same.

AND/OR For issuance of any other appropriate writ, order or direction as this Hon'ble Court may deem think appropriate in the peculiar facts and circumstances of the present case.”

Learned counsel for the petitioner has submitted that in the present case, the respondent-authorities have held e-auction for which there was due advertisement and the petitioner was successful in e-auction and was the highest bidder for plot No.1924, Sector 26, Panchkula and in addition to 5% of the earnest money deposit, has further deposited 10% of the highest bid amount and has thus, deposited total amount of Rs.3,10,91,40/-. It is submitted that till date, neither letter of intent has been issued nor allotment letter has been issued nor any money along with interest has been returned in spite of the fact that the petitioner has made repeated visits and is ready to comply with all the terms and conditions of the advertisement. It is further submitted for the redressal of his grievance, the petitioner has given legal notice dated 16.07.2026 (Annexure P-6). It is further submitted that at this stage, the petitioner would be satisfied in case Estate Officer, HSVP, Panchkula is directed to decide the same in a time bound manner and in case the pleas of the petitioner are found to be meritorious then necessary relief would also be granted to the petitioner..

Learned counsel for the respondents has submitted that the said legal notice dated 16.07.2026 (Annexure P-6) would be considered and decided by the Estate Officer, HSVP, Panchkula, within a period of two months from today

Keeping in view the abovesaid facts and circumstances, the present writ petition is disposed of with direction to the Estate Officer, HSVP, Panchkula to consider and decide legal notice dated 16.07.2026 (Annexure P-6) by passing a speaking order within a period of two months from today. In case, Estate Officer, HSVP, Panchkula finds that the pleas raised by the petitioner are meritorious then necessary relief would also be granted to the petitioner expeditiously.
