The petitioner through instant petition under Articles 226/227 of the Constitution of India is assailing show cause notice dated 22.05.2016 whereby he was called upon to show cause as to why penalty of reduction in rank should not be imposed upon him.
This Court while issuing notice of motion on 03.06.2016 stayed passing of final order.
Learned State counsel submits that no order qua aforesaid show cause notice has been passed, however, petitioner has been dismissed from service vide order dated 09.12.2025 passed by Additional Director General of Police, Hisar Range, Hisar.
Faced with this, learned counsel for the petitioner submits that petitioner has filed appeal against order dated 09.12.2025 whereby he was dismissed from service. The instant petition, at this stage, may be disposed of, however, liberty may be granted to the petitioner to move an appropriate application, if cause survives.
In the wake of statement of learned counsel for the petitioner, the petition stands disposed of with liberty to the petitioner to move an appropriate application if, at any stage, respondent-State starts proceedings qua impugned show cause notice.
