By way of the present writ petition, the petitioner has claimed that he should have been treated as a candidate of Non-Gazetted Employee (NGE) category.
The matter was heard for quite some time on 19.09.2023, and during the course of hearing Mr. Joshi was asked to inform as to whether the petitioner is likely to be selected, if he is held to be a ‘NGE’ category candidate?
Mr. Tarun Joshi, learned counsel for the respondents submitted that as many as 26 posts were advertised for Non- Gazetted Employee (NGE) category candidates and the petitioner has stood at merit No.32. Hence, even if the petitioner is held to be a candidate of Non-Gazetted Employee (NGE) category, in no eventuality he can get the appointment.
Learned counsel further submitted that in combined recruitment examination for State services, waiting list is never published or operated having regard to the nature of the recruitment.
In view of above facts situation, this Court is of the view that the issue in hands has remained academic only and the entire exercise would be futile if the writ petition is decided on merits. Hence, the writ proceedings are closed.
Needless to observe that the petitioner’s right to assert that he should be considered as Non-Gazetted Employee (NGE) category candidate shall stand reserved and issue in hands will be open to be decided in appropriate case.
Stay application also stands disposed of, accordingly.
