The petitioner has raised the dispute of inter-se seniority on the ground that the respondents have not complied with the judgment rendered by the Supreme Court in Civil Appeal No. 9247 of 2019 dated 06.12.2019. According to the petitioner, the Uttarakhand Peyjal Sansadhan Vikas Evam Nirman Nigam has not followed the 100-point roster in relation to the total cadre strength.
The dispute raised by the petitioner, in the present Writ Petition, squarely falls within the jurisdiction of the Uttarakhand Public Services Tribunal. Even earlier, the same dispute was taken before the said Tribunal and dealt with it.
We are, therefore, not inclined to entertain this Writ Petition at this stage. We, accordingly, dismiss this Writ Petition, with liberty to the petitioner to approach the Uttarakhand Public Services Tribunal. Considering the fact that the issue of inter-se seniority has been hanging fire since year 2004-05, we request the Tribunal to hear the petitioner, if he approaches the Tribunal within the next two weeks, as early as possible.
In sequel thereto, pending application, if any, also stands disposed of.
