Judgment
Kurian Joseph, C.J.—The petition is filed with the following prayer:
(A) That the appointment of Respondent No. 4 may very kindly be quashed and set-aside and Respondents Nos. 1 to 3 may very kindly be commended with appropriate writ, order or direction to give appointment letter to the applicant.
In para 2 of the preliminary submissions of the reply filed by Respondent No. 3, it is stated as follows:
That the Respondent No. 1 had granted permission to the Respondent No. 3 to engage driver on contract basis @ Rs. 2000/ - per month for a period of six months, vide letter dated 4th June, 1999. The Respondent No. 3 had sent the requisition to the concerned Employment Exchange for engaging driver on contract basis @ Rs. 2000/ - per month. It is further submitted that the names of six candidates including the applicant and Respondent No. 4 were sponsored by Employment Exchange, Amb for the post of tractor driver on contract basis for six months. As many as six candidates including the applicant and the Respondent No. 4 were directed to make themselves available for interview on 24.12.1999 at 11.00 a.m. in the office of the Nagar Panchayat, Daulatpur Chowk. The applicant as well as Respondent No. 4 and other candidates were interviewed for the post of tractor driver by a Selection committee duly constituted by the Respondent No. 1. The Selection Committee found Respondent No. 4 as the most suitable candidate and his name was recommended for engagement for the post of tractor driver for a period of six months. The appointment letter was issued to the Respondent No. 4 on 1st January, 2000, pursuant to which the Respondent No. 4 has joined his duties on 3rd January, 2000.
In view of the stand taken in the reply as stated above and in view of the intervening developments, in case the Petitioner has still any grievance left, he may approach the 1st Respondent, in which case, the 1st Respondent will look into the matter and take appropriate action in accordance with law and justice within four months from the date of production of a copy of this judgment alongwith copy of the writ petition by the Petitioner.
The petition is disposed of, so also the pending application(s), if any.
