A letter dated 05.12.2023 has been forwarded by the learned trial court seeking extension of time for recording the statement of the Investigating Officer.

This Court vide order dated 29.08.2023 while dismissing S.B. Criminal Misc. Bail Application No.9198/2023 (Sunil Vs. State of Rajasthan) as withdrawn directed to learned trial court to record the statement of the Investigating Officer as the first witness preferably within two months.

It is emanating from the letter that due to inevitable and unavoidable circumstances, the learned trial court could not record the statement of the Investigating Officer within the stipulated time period and, therefore, the learned trial court vide letter dated 05.12.2023 seeks more time to do the needful.

Considering the overall facts, circumstances and the reasons mentioned in the letter dated 05.12.2023 sent by the learned trial court, this Court deems it appropriate to extend the time to record the statement of the Investigating Officer as first witness.

Accordingly, the instant criminal misc. application is allowed. The time granted to learned trial court vide order dated 29.08.2023 passed in SBCRLMB No.9198/2023 is hereby extended. The trial court shall make sincere endeavour to record the statement of Investigating Officer as first witness within six months from the date of receipt of a copy of this order.
